The Soulse domain (soulse.in) ("Soulse Platform") and any related applications and services (the latter collectively, “Soulse Services”) are made available by Beagles Private Ltd. (hereinafter also “Soulse,” “Company,” “we,” “us,” and “our”). This document describes how we collect, store, and process your personal information in relation to the Soulse Platform and Soulse Services, including through collaboration with third party service providers (“Partners”).
By accessing or using the Soulse Platform or Services, or by otherwise giving us your information, you confirm that you have read, understood, and expressly agree with the privacy practices described in this Policy, and with the collection, storage and processing of your information in accordance with them. Therefore, please read this Policy carefully. If you have any questions, please reach out to info@soulse.in. If you don’t want us to collect or process your personal information in the ways described in this Policy, you shouldn’t use the Soulse Platform or Services.

If you are under the age of 18, please do not use the Soulse Platform and Services. Please note that we do not verify a user's age and are not liable for any under-age usage of our Platform or Services. You are solely responsible for verifying the age of any users you engage with on the SoulSe Platform. You are also responsible for any and all account activity conducted by a minor on your account. If you believe we might have any information from or about a minor, please contact us at info@soulse.in. We will take appropriate steps to delete information and accounts of users under the age of 18.
Your Consent: By using the Soulse Platform or Services, you agree and consent to the collection, transfer, use, storage, disclosure and sharing of your information, including to third parties whether in India or abroad, as described and collected by us in accordance with this Policy. If you are accessing or using the SoulSe Platform or Services from an overseas location, you do so at your own risk, and shall be solely liable for compliance with any applicable local laws.
As a Seller you undertake to comply with applicable law and notify Buyers and obtain their consent for collection, use and further sharing of their personal data by you as the Seller through your brand’s privacy policy and terms and conditions.
Policy Updates: We may occasionally update and modify this Policy without prior notice and any such changes will be effective immediately upon being posted on this page. To the extent permitted under applicable law, your continued use of the SoulSe Platform or Services after we publish changes to this Policy shall constitute your consent to the updated Policy.
Links to Third Party Websites/Apps: The Soulse Platform and Services may contain links to other websites and applications. Any Personal Data about you collected when accessing such third party websites or apps is not governed by this Policy. We are not responsible for, and have no control over, the privacy policies, practices and content of Sellers, Partners, or any external website or app which may be linked from the Soulse Platform or Services. You further acknowledge and agree that we are not liable for any loss or damage which may be incurred by you as a result of the collection and/or disclosure of your information by Sellers, Partners, or via third party websites or apps, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, services, or other materials on, or available via such third party links. This will include all transactions, and information transmitted therein, between you and any such third-party sites or applications or resources, and such transactions are strictly bi-partite. You will not make us a party to any disputes arising from or in connection with such transactions between you and the aforementioned third parties.
Types of Information We Collect from You: Depending on whether you are a Seller, Buyer, or Partner of SoulSe, we may collect different types of information from you.

a. Personal Data Collected from Sellers: If you are a Seller offering your products for sale on our Platform, we collect all information that you provide to us about yourself and your business, including but not limited to your name, details of individuals associated with your business, name and address of your business, email address, phone number, social media handles, and copies of government issued identification. We may also collect sensitive personal data or information (“SPDI”) about you when you use our Service(s) on the Soulse Platform. This information may include financial information, identity information, business documentation, contracting and other related information we receive from you or, on your behalf, such as your payment gateway information.

b. Personal Data Collected from Buyers: If you are a Buyer accessing the Soulse Platform, you understand that we, the Sellers, and our Partners may collect certain personal data from you including but not limited to your name, billing address, email address, phone number, social media handles used for registration/sign-in, shipping address, transaction details and payment details. While this Policy sets out the Purposes for which we collect and process your personal data and our privacy practices in relation to such data, you understand and acknowledge that this Policy does not cover privacy practices of the Sellers who you transact with or our Partners that are providing you any services. You acknowledge that Soulse is not responsible for, and has no control over, the practices and content of the privacy policy of Sellers and Partners.
If you choose to post any messages, images, photos, or other content on our Platform, including during our online popup events, we will collect that information you provide to us. Please note that any content posted by you on our Platform will generally be in the public domain and can be read by others as well, which is why we ask you to please exercise caution while posting such information. We retain this information as necessary to resolve disputes, provide customer support, conduct internal research and troubleshoot problems as permitted by law.
c. Personal Data Collected from Partners: If you have partnered with us to facilitate our provision of Services to the Sellers, we may collect information you provide about yourself and your business, such as your name, details of individuals associated with your business, name of your business, address, email address, phone number and copies of government issued identification. We may also collect data relating to the transactions between you and the Sellers, such as status of an order, settlement amount of an order, to enable us to provide services to the Sellers or otherwise optimize the functionality of the Platform.
d. Other Information: In order to improve your experience on our Platform and lend stability to the Services we provide to you, we may collect information or employ third party plugins that collect information about the devices and computer browser you use to access our Services, as well as about your IP address, and similar such information. We might also receive information and Personal Data about you from publicly available sources, information shared by social media platforms you are associated with, and from other sources including from the third party providers and advertisers we work with.
How We Use Cookies: We, as well as our Sellers and Partners, may use data collection devices such as “cookies” to collect and store information with respect to your use of the Services and third-party websites. Cookies are small files that are stored on your browser or device by websites, apps, online media and advertisements. We use cookies and similar technologies for purposes such as user authentication, remembering user preferences and settings, analyzing Soulse Platform traffic, trends, and user interests, and for advertising purposes. To modify your cookie settings, please visit your browser’s settings. By using our Services with your browser settings to accept cookies, you are consenting to our use of cookies in the manner described in this section. Please note that we do not control, or are responsible for, the use of cookies by Sellers, Partners, or other third parties.
How We Use Your Information: Soulse uses your personal information to provide you with our Services. To the extent we use your personal information to market to you, we will provide you with the opportunity to opt-out of such uses. We use your personal information to assist Sellers and Partners in handling and fulfilling orders; to customize and otherwise enhance your customer experience; to resolve disputes; to troubleshoot problems; to help promote a safe service; to collect money; to measure consumer interest in our products and services, and to inform you about online and offline offers, products, services, and updates; to detect and protect us against error, fraud and other criminal activity; to enforce our terms and conditions; to conduct marketing research, analysis and surveys; and as otherwise described to you at the time of collection of information.
We will ask for your permission to allow us access to your text messages (SMS), instant messages, contacts in your directory, camera, photo gallery, location and device information to (i) send commercial communication regarding your orders or other products and services; and (ii) enhance your experience on the Platform and provide you access to the products and services offered on the Platform by Sellers, affiliates, or Partners. You understand that your access to these products/services may be affected in the event permission is not provided to us. In our efforts to continually improve our product and service offerings, we collect and analyze demographic and profile data about users' activity on our Platform. We identify and use your IP address to help diagnose problems with our server, and to administer our Platform. Your IP address is also used to help identify you and to gather broad demographic information.
Disclosure and Distribution of Your Information: In some situations, we may share your information with third parties, including Sellers and Partners. This disclosure may be required for us to provide you access to our Services and the products offered to you, to comply with our legal obligations, to enforce our user agreement, to facilitate our marketing and advertising activities, to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our services. We may disclose personal data and SPDI to government agencies or other authorized law enforcement agencies if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to (i) enforce our Terms or Privacy Policy; (ii) respond to claims that an advertisement, posting or other content violates the rights of a third party; or (iii) protect the rights, property or personal safety of our users or the general public. We may share your information other than as described in this Policy if we notify you and you consent to such sharing.
Data Security Precautions: To protect your personal information from unauthorized access or disclosure, loss or misuse we adopt reasonable security practices and procedures. Please be aware, however, that the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted through the Soulse Platform or in connection with our Services. Once we have received your information, we will use strict physical, electronic, and procedural safeguards to try to prevent unauthorized access. If you suspect any unauthorized use of your account, you must immediately notify us by sending an email to info@soulse.in. You shall be liable to indemnify us for any loss suffered by us arising from any unauthorized use of your account or password. We shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond our reasonable control. As a Seller or Partner, to the extent you collect SPDI of Buyers, you agree to comply with your obligations of having in place reasonable security measures, in accordance with applicable law.
Data Retention: We retain your personal information for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, we may retain data related to you if there is a legal obligation to retain the data; if required to comply with any applicable statutory or regulatory retention requirement by law; if we believe it may be necessary to prevent fraud or future abuse; to enable Soulse to exercise its legal rights and/or defend against legal claims; or for other legitimate purposes. We may continue to retain your data in anonymized form for analytical and research purposes.
Opt-out and Consent Withdrawal: When you sign up for an account, you are opting in to receiving emails from Soulse. You have the opportunity to opt-out of non-essential (i.e., promotional, marketing-related) communications by emailing us at info@soulse.in. If you wish to withdraw your consent for the use and disclosure of your personal information in the manner provided in this Policy or you want your data to be deleted, please write to the Soulse Grievance Officer at info@soulse.in. Please note that we will verify any such requests before acting on them, that consent withdrawals will not be retroactive, and that we may not be able to offer you any or all Services upon such withdrawal of your consent. If you are withdrawing your consent and have used or agreed to use any third party merchant or service provider, you will need to notify and approach such third party merchant or service provider directly for your request. We do not control the data privacy practices of our Partners or other third parties and are therefore not liable for any of their practices in relation to your personal data.

Corrections and Amendments to Your Information: You may review, correct, update, and change the information that you have provided to us. You should be aware that some of the Personal Data that may have been shared on third-party websites may still continue to be available as we do not have control over these websites. Your Personal Data may also appear in online searches. As a Seller, you agree to promptly, and no later than 24 (twenty four) hours, inform us of any request from a Buyer to modify, amend or delete any information of the Buyer that has been shared with us and any other notices or communications that Buyer may make in relation to their data on the Soulse Platform. Further, as a Seller, you agree to comply with any data correction, erasure, deletion or other similar obligations. As a Buyer, if you wish to make any request for amendment, correction, updating or deletion of information, you should also make the request directly to the Seller in accordance with the Seller’s privacy policy. While we require Seller to promptly support your request, we are not responsible for the Seller’s compliance with such request.

Disclaimer: We cannot ensure that all of your Personal Data and SPDI will never be disclosed in ways not otherwise described in this Policy. Therefore, although we are committed to protecting your privacy, we do not promise, and you should not expect, that your information or private communications will always remain private. While using the Soulse Platform, or availing any of our Services, you understand and agree that you assume all responsibility and risk for your use of the Soulse Platform, and Internet generally, and the information you post or access and for your conduct on and off the Soulse Platform.
Joint Data Controllers: If Soulse and you as a seller are found to be joint data controllers of personal information, and if Soulse is sued, fined, or otherwise incurs expenses because of something that you did in your capacity as a joint data controller of buyer personal information, you agree to indemnify, defend and hold Soulse (and its employees, agents, consultants, subsidiaries, partners, affiliates, and licensors) harmless against any claims, costs, losses, damages, liabilities, judgements and expenses (including reasonable lawyer fees) in connection with your processing of buyer personal information.
Indemnity: You agree and undertake to indemnify us in any suit or dispute by any third party arising out of disclosure of information by you to third parties either through our Soulse Platforms or otherwise and your use and access of websites, applications and resources of third parties.
Severability: Each clause of this Policy shall be and remain separate from and independent of and severable from all and any other clauses herein, except where otherwise expressly indicated or indicated by the context of the Policy. The decision or declaration that one or more clauses are null and void shall have no effect on remaining clauses of this Policy.
Limitation of Liability: Soulse shall not be liable for any consequential, incidental, special, indirect, exemplary or punitive damages, or damages for any loss of profits, revenue or business, regardless of the nature of the claim, even if the Soulse has been notified of the possibility of such damages.
Governing Law and Jurisdiction: This Policy shall be governed by the laws of India as applicable between residents of India without regard to any principles of conflict of laws. Subject to our Terms of Use, any and all disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts at Bangalore, India.
